September 22, 2003 Present: Cris Irsfeld, Deb McMenamy, George Shippey, Attorney Philip Heller, Pam Sander-Rota, Marshall White and Jorja Marsden The Selectmen awarded the hauling for 2003 to the Master Garbologist for one year. Cris opened the special permit for the Warheit’s with the reading of the Planning Boards recommendation. The Planning Board stated “After determining that the application did not seem to be more detrimental to the neighborhood and seemed to meet the requirements of section 6.1.2, the Board voted to recommend approval of the 6.1.2 special permit to the Selectmen.” The Selectmen unanimously voted the following findings: A The alteration and reconstruction are in compliance with all provisions and requirements of the bylaw, and in harmony with its general intent and purposes. Section 6.1.2 provides that a special permit is authorized for the reconstruction of a pre- existing, nonconforming structure that has been voluntarily demolished, provided that the special permit is issued prior to the demolition. There will be no change in footprint or setbacks as a result of the construction of the new dwelling. The upgrading of property in Stockbridge is consistent with Section 1.2, Purposes, as it will conserve the value of land and buildings within the town. B. The proposed alteration and reconstruction is essential and desirable to Public convenience and welfare at the proposed location. The upgrading of the existing building is a benefit to the public. All setbacks will be maintained, and the building is sufficiently set back from Stockbridge Bowl, a distance of 3 7 feet, so that the construction will not adversely impact the lake. C. The alteration and reconstruction will not be detrimental to adjacent uses or to the established or future character of the neighborhood. The neighborhood consists of small cottages located on small lots. There has been significant alteration and reconstruction of other cottages in the neighborhood. The existing building is in a serious state of disrepair, and it is not economical to rehabilitate the existing structure. There is sufficient setback from the west, east and south setbacks so as not to adversely impact abutters. The design of the new dwelling is aesthetically consistent with properties in the neighborhood. The dwelling is located within 150 feet of Stockbridge Bowl, and the applicants have filed a special permit with the Planning Board pursuant to Section 6.5, Lake and Pond Overlay District. The dwelling has been designed so that there will be no adverse impact on the environment, public health or safety. D. The addition will not create undue traffic congestion or unduly impair pedestrian safety. The dwelling on the property will continue to be a single-family dwelling, and there will not be any adverse impact on vehicular or pedestrian traffic. E. The proposed expansion will not overload any public services to the property as it is served by a well and town sewer. George made a motion to approve the application. Deb seconded the motion. The vote to approve the application was unanimously voted.
