Thu, Aug 23, 2007 7:45 AM From: Howard Siegel To: StockbridgeMA_SelMin Subject: July 30, 2007 July 30, 2007 Present: George Shippey, Deb McMenamy, Robert Flower, Joy Ziefer, Haldor Reinholt, Attorney Lori Robbins, Max Montgomery, Stu Benedict, Don Schneyer, Derek Gentile, Karen Passmore and Jorja Marsden George welcomed everyone to the selectmen’s meeting and announced that there was a full agenda. First on the agenda was a request from Joy Ziefer of 1862 Seasons On Main at 47 Main Street. Ms. Ziefer requests from the Selectman, approval of trailblazing signs on Mass Highway Property to advertise the bed and breakfast. Mass Highway signs must have written approval from each community and approval from Mass Highway. The maximum number for each community is two; size, color, and mounting are all specified by Mass Highway. After discussion of possible locations, the Selectman agreed that they would send a letter to Mass Highway for the two signs; one along Route 7 south from Lenox, closer to Stockbridge where there are 2 signs, preferably closer to Main Street and the other one along Route 102 from Church Street, South Lee and to Yale Hill in Stockbridge. The legal notice for the Donald and Rosemary Schneyer special permit at 10 Glendale Middle Road was read. The notice was published in the Berkshire Eagle on Monday, July 16, 2007 and Monday, July 23, 2007. The Schneyers’ wish to construct a 13’ by 18’ addition on the west side of the property. The property is located in the R-1 zone. Application is made under section 6.1.2. George read a letter from Lawrence and Cheryl Bell, abutters to the property owner, that they had no problem with the addition the Schneyers’ wish to build. George also read the favorable recommendation from the Planning Board. The Selectman made the following findings: a. The application is in compliance with all provisions and requirements of this Bylaw, and in harmony with its general intent and purpose; and b. Is essential or desirable to the public convenience or welfare at the proposed location; and c. Will not be detrimental to adjacent uses or to the established or future character of the neighborhood; and d. Will not create undue traffic congestion or unduly impair pedestrian safety; and e. Will not overload any public water, drainage, or sewer system or any other municipal facility to such an extent that the proposed use of any existing use in the immediate area or in any other area of the town will be unduly subjected to the hazards affecting public health, safety or general welfare. Deb made a motion to approve the application as presented. Bobby second the motion. The application was approved unanimously. Attorney Lori Robbins came before the Selectmen with a permanent sign permit requested for the Berkshire Theatre Festival. The sign is for the front of the property on East Main Street. Bobby asked if the sign will have lights. Attorney Robbins stated she did not know if it will be illuminated or not. Attorney Robbins stated that the sign request meets the requirements of the by laws, is a wooden 2x2 sign standing 6’ tall. Deb made a motion to approve the sign request. The motion was seconded by Robert. The selectmen unanimously approved the sign request from BTF. At the Selectmen’s meeting of July 30, 2007, Attorney Lori Robbins and Haldor Reinholt came before the Board to discuss the special permit request that is before the Planning Board for approval of two separate common driveways, each serving 2 lots with a maximum grade of more than 10%. The Board of Selectmen after speaking with Town Counsel regarding this application, informed Attorney Robbins and Mr. Reinholt that they should withdraw the application as presented, as the description on the special permit application does not match the plans and that they are in violation of the zoning bylaws as the driveways have already been built without a special permit approval by the Planning Board. Therefore the Board of Selectmen is not giving a recommendation to the Planning Board on this application. Jon Earle, intern from Williams College, and Sarah Gardner, teacher, came before the Selectmen to see if Stockbridge would like to join other towns in Berkshire County, Great Barrington, Lenox, and Pittsfield who have signed on to cities for climate protection to estimate greenhouse gas emissions with the towns, and to identify actions that the Town could take to reduce emissions. Jon explained that he would first look at the electricity, gas, oil and gasoline invoices for the last year. Robert asked if we should set up a committee to monitor the gas emissions for the future. Jon stated that would be helpful and that there should be committee members that come from other businesses, homeowners and non-profit groups. Jon continued by saying that once the estimate is done from the Town; he will go further to estimate the total gas emission within Stockbridge. The Selectman suggested that Jon contact Jorja for the Town’s information. Jon said that he would give us a report after he views the emissions from just Stockbridge. Max Montgomery and Stu Benedict came before the Selectman regarding cross walks within Town – in particular - regarding the one on Elm Street from the Library to the Post Office and the one from the Red Lion Inn going west. The Selectmen felt that possibly the sidewalk could be painted going from the Red Lion west, however they would have to check with the MassHighway Department as that part of the street is State. The crosswalk that goes from the Library to the other side is not a crosswalk. It should be painted over. The Selectmen will speak with Clint in the Highway Department and Chief Wilcox. One other thought for the crosswalks is placing the green pedestrian signs on the edge of the Route 7 crosswalks so that the traffic will slow down as they enter Route 7. Bobby made a motion to adjourn at 8:10. Deb seconded the motion. The change order ranges from deleting aluminum panning at some windows; changes in wooden doors; structural modifications to the gym roof; change in hardware; additional sprinkler coverage for gym and attic crawl spaces; lighting changes; extra ceiling molding and additional repairs to the second floor. Deb made a motion to approve change order 7 for the Plan School Town Office project. Bobby seconded the motion. The motion to approve change order 7 was unanimous. Some discussion took place regarding the trees in front of the Plain School. The trees are very large and have caused problems in the past. The Tree Warden had the trees trimmed, however, there is concern that the trees are structurally encroaching on the structure. The Selectmen feel that the trees should be removed. Jorja was instructed to call the Tree Warden. Deb made a motion to offer the job of Assistant to the Town Administrator to Danielle Salice of Lee. Bobby seconded the motion. The motion to offer the Assistant to the Town Administrator’s position to Danielle Salice was unanimous. Deb made a motion to approve the contract for the Town Administrator. Bobby seconded the motion. The vote to approve the contract for the Town Administrator was unanimous. With no other business, Deb made a motion to adjourn at 8:55 a.m. A second was received from Bobby. The vote to adjourn was unanimous. A true copy, ATTEST:
