Details Link Name: Meeting Minutes Description: Subject/Title: July 12, 2005 Subtitle: Keywords: Review on: [ ] Default to Printable Version STOCKBRIDGE PLANNING BOARD JULY 12, 2005 MEETING MINUTES PRESENT: Doug Rose, Gary Pitney, Allan Blau, Paul Coates, Barbara Cohen Hobbs ABSENT: Eric Plakun and Bob Bartle Meeting was called to order at 7:30 p.m. Minutes of the June 28th meeting were reviewed and Member Pitney moved to approve them as submitted. Member Blau seconded, and the motion carried. Mr. Richard Rothbard appeared with Lori Robbins and Steven Mack for a review of a special permit application for his restaurant on South Street. His original special permit allowed 42 seats; he would like to increase it to 48 seats and add parking spaces to accommodate the additional patrons. The parking area has room for 25 spaces, but only 23 are being asked for in the application. That would allow for 17 patron spaces, 2 for the second floor apartment, and 4 for staff. The property is nonconforming because there is less than the required 50-foot setback for the parking area. Mr. Rothbard would also like to extend the closing time to 11:00 p.m., but that is not being reviewed here. The Board asked what the original special permit conditions were, and were told the following: no open flame; exhaust fan placement; trash stored inside; fence to prevent exit onto Maple St.; closing time at 10:00 p.m.; yearly review by the Selectmen. Mr. Rothbard explained that the increased seats would be to accommodate porch seating in the summer. He also would like to add live music, and add seats on the lawn for patrons waiting for tables. Member Coates asked why all the changes were being requested, and was told that he would like to increase revenue. With little discussion, Member Coates moved to recommend to the Selectmen that the Planning Board professes no opinion and to let the Selectmen make their own determination. Member Pitney seconded the motion, and opened the motion up for discussion. Member Blau felt it was an inappropriate motion. A vote was called and the motion failed 2-3. Member Blau then recommended approval of the application as submitted to the Selectmen, and Member Hobbs seconded. Member Coates said that he felt the application shouldn’t be approved and Mr. Rothbard should live by the conditions of his original application. Board then voted 3-2 to approve the motion. With no further business, the meeting was adjourned at 8:00 p.m.
