The minutes of December 13th meeting were reviewed and Member Hobbs suggested one change. Member Pitney moved to approve the minutes of December 13th as amended. Member Plakum seconded and it was unanimously approved, 5-0. Marc DiGrigoli represented Louis DiGrigoli and James V. Walker in the review of a proposal for a Special Permit under Section 6.1.2. The proposal is the demolition of a preexisting nonconforming house, pool and shed to allow the construction of a new two family dwelling within the required setbacks and to renovate the existing garage. The property is located at 12 South Street in the R-4 zoning district. Mr. DiGrigoli stated that currently there is an apartment over the existing garage and their intent is to eliminate it. There was a discussion regarding the apartment over the garage and whether it has been occupied and if not the use which is nonconforming has been abandoned. Member Plakun stated that the Board of Selectmen needs to determine whether the use of the apartment has been abandoned. Member Plakun made a motion that in the review of this application the board was faced with a question whether or not the use of the apartment over the garage has been abandoned which couldn’t be determined at this time. Under Section 6.1.5 it needs to be established if the nonconforming use has been abandoned. If the Board of Selectmen finds that that the use has not been abandoned then the board would endorse the proposal, which would decrease the nonconforming status of the property. This motion was seconded by Member Hobbs and was unanimously approved, 5-0. With no further business, Member Plakun moved to adjourn.
