February 13, 2007

MINUTES

Present:  Chairman, Doug Rose, Gary Pitney, Barbara Cohen Hobbs, Eric Plakun, and Paul Coates 

Absent: Robert Bartle and Eugene Talbot

Member Pitney made a motion to approve the minutes of January 23, 2007 as written.  Member Hobbs seconded this motion and it was unanimously approved, 5-0.

Attorney David Hellman represented Alan Hirshberg in a request for an extension of an approval of a Definitive Subdivision plan, which was approved on May 2005. 

Attorney Hellman requested a 2-year extension expiring on May 2009. Attorney Hellman stated the reason for the extension is that Mr. Hirshberg at the time of the approval entered into a contract for the sale of one of the lots and the sale was subject to the Conservation Commission's approval for the building site.  After many months of hearings and site visits, the Conservation Commission did not approve the building site location and the result the sale did not consummate.  Mr.Hirshberg appealed the decision of the Conservation Commission to DEP and on August 11, 2006, the DEP issued a superseding Order of Conditions.  Mr. Hirshberg is requesting an extension of time to complete the work on the subdivision road and utilities until May 27, 2009.

Member Coates made a motion to approve the request for an extension for a period of 2 years.  Member Hobbs seconded this motion and it was unanimously approved, 5-0.

Member Hobbs made a motion to adjourn this meeting at 8:00 P.M.  Member Pitney seconded this motion and it was unanimously approved, 5-0.
