Details Link Name: Minutes Description: Subject/Title: July 12, 2005 Subtitle: Keywords: Review on: [ ] Default to Printable Version CONSERVATION COMMISSION MINUTES OF MEETING TUESDAY, JULY 12, 2005 PRESENT: Sally Underwood-Miller, George Shippey, Don Deno, John Hart Joseph DeGiorgis ABSENT: Cathy Plakun, Stephen Shatz Call Meeting to Order/Adopt Minutes – The Chairman called the meeting to order at 7:00 p.m. Member Shippey made a motion to adopt the Minutes as presented, seconded by member DeGiorgis and all voted in favor. Member Shippey made a motion to nominate Sally Underwood-Miller as Chairman of the Commission, seconded by member Hart and all voted in favor. Member Hart made a motion to nominate member Shatz as Vice-Chairman of the Commission, seconded by member DeGiorgis and all voted in favor. The Chairman read into record an e-mail from Steven Mack of Foresight Land Services, Inc. regarding the proposal to mow an open field on Lot 5A on Stonehill Rd., currently owned by Mark Weber. It was decided that if it’s been mowed since 1990 and there are no proposed changes, then it is maintenance of existing conditions and no filing is required. No trees will be cut, just maintaining a meadow. TEC Associates for the Housatonic Railroad, RDA – Sam Bartlett, representing TEC Associates, appeared to discuss the proposal to do vegetation management and the yearly spraying plan along the railroad. They use a Round-Up type solution and will spray approximately ten feet from a wetland. A high rail truck is used to do the spraying. The Commission goes on record as not being in favor of this type of spraying. Member Hart made a motion to close the hearing, seconded by member Shippey and all voted in favor. Barbara Cohen-Hobbs, 17 Mahkeenac Rd, RDA Continuance – Shannon Boomsma of White Engineering, Inc. appeared representing the applicant who is proposing to resurface her existing partial gravel and partial oil and stone driveway with blacktop with a top coat of oil and stone. Member Shippey did a site visit to the property and after talking with the applicant he supports the proposal to pave the driveway. The driveway is 13% and the landing is 4% grade. Member DeGiorgis made to accept the proposal and close the hearing, seconded by member Shippey and all voted in favor. Harvey Waller (Estate of Bertha Skevington), Goodrich St., NOI Continuance – Shannon Boomsma of White Engineering, Inc. appeared representing the applicant who proposes to create a two-lot subdivision on the 39+ acre parcel. The Commission received a proposal from Baystate Environmental Consultants, Inc. (BEC) to do a peer review of the project and Mr. Waller will have to give approval to pay for said review in the amount of and not to exceed $1,200. Ms. Boomsma will contact the secretary giving the authorization and the secretary will e-mail BEC of such. The Chairman read into record the letter from BEC which gives a scope of work and the price to do so. Member Shippey made a motion to hire BEC pending the applicants’ approval, seconded by member DeGiorgis and all voted in favor. The center should be flagged and staked. The hearing was continued to the next meeting. Dean Olsher, 8 Interlaken Crossroad, NOI Continuance – Michael Kulig of Berkshire Engineering appeared representing the applicant who is proposing to install a low pressure sewer to a connecting approved line of Roy Komack on Interlaken Crossroad. Mr. Kulig reported that the Sewer and Water Commission gave preliminary approval of the project and asked them to put in additional stubs for others to tie in. Mr. Kulig addressed DEPs’ remarks: 10 linear ft. of bank disturbance: This an error, as the method of installation proposed for this portion of the project is horizontal directional boring and, therefore, there is no disturbance of bank proposed. Exemption for Buffer Zone work for Riverfront Area work: They are claiming no exemption for the proposed work related to Buffer Zone. Depth for Installation of force main: They do not anticipate encountering groundwater in any appreciable quantities, as the depth for installation for the majority of the main is approximately four ft. If groundwater is encountered it would be pumped from the work area and filtered through a minimum of two layers of filter fabric prior to discharge to an upland or Buffer Zone area. Dewatering: There will not be a lot of dewatering but maybe some at a manhole. Buffer zone disturbance: the project is all buffer zone disturbances so they are not filing under a Limited Project Status. As requested by the Commission at previous meeting, a sleeve will be installed where the line is planned to cross beneath the culvert which passes under the road. This is shown as Revision 1 of the revised plan. Member Hart made a motion to close the hearing, seconded by member DeGiorgis and all voted in favor. The Chairman will e-mail Peter Kolodziej of Tri-Town Health Dept. giving him a progress report of the project. Dawn Farley, 90 East Main St., RDA Continuance – Michael Kulig of White Engineering, Inc. appeared with the applicant who proposes to install a sewer force main from her property along East Main St. under the road to connect to an existing manhole at the intersection of Yale Hill Rd. Members Shippey and Shatz did a site visit and had no problems with the proposal. Mr. Kulig reported that the Sewer and Water Commission gave preliminary approval and asked them to put in stubs for others to tie in. Member Shippey made a motion to close the hearing, seconded by member DeGiorgis and all voted in favor. The Commission signed a Negative Jurisdictional for the Stockbridge Clubs’ condo at 8 Church St. The Commission signed Determinations of Applicability for Louis DiGrigoli of 12 South St., John Hyson of 3 Butler Rd. and I. Michael Goodman of 18 Ice Glen Rd. The Commission signed an Order of Conditions for Barbara Berk of 28 Lake Drive. The Commission reviewed two jurisdictionals filed by Carl Edwards of 5 Butler Rd. One is a filing for the placement of a small gazebo near the river and it was determined that an RDA needs to be filed. The other is for an addition to the barn on the property and it was determined that this was a negative jurisdiction.
