CONSERVATION COMMISSION MINUTES OF MEETING TUESDAY, AUGUST 22, 2006 PRESENT: Sally Underwood-Miller, George Shippey, Don Deno, John Hart ABSENT: Stephen Shatz, Cathy Plakun, Joseph DeGiorgis Call Meeting to Order/Adopt Minutes - The Chairman called the meeting to order at 7:00 p.m. Member Shippey made a motion to adopt the Minutes as presented, seconded by member Deno and all voted in favor. John & Judith Peyron, Larrywaug Crossroad/Interlaken Rd. - NOI - Michael Kulig of Berkshire Engineering appeared representing the applicants who propose to construct a single-family house and install a well and septic system on an 8+ acre parcel behind their house on Interlaken Rd. The Chairman read into record a letter submitted by the abutters to the property. The Chairman stated that the Commission will look at the plan as presented before them and that anything that is presented at a later date, and while the Commission would be concerned about it, it is not before them at this time. This was a concern expressed by the abutters in their letter. M. Kulig stated that there has been an administrative change in the NOI which is the name change from John & Judith Peyron to Larrywaug Land Trust who is the owner of record. M. Kulig stated that there is a wetland that extends through the Turnpike and runs down to Larrywaug Rd. There is a substantial wetland in back of the property. The proposed driveway is 30 ft. in from the property line. M. Kulig stated that there is no crossing of the wetland proposed. John Peyron, Sr., an abutter, stated that many years ago it was a dry area and when the Turnpike was put in they created the wetland. He also stated that when he built his house he put in 32 tons of stone in his cellar and put in a drain all along the parameter at the base of the footing. He has 3 ft. of stone out from the house and 3 ft. high to catch water that goes into the drain. He stated that prior to John Peyron, Jr. filling in the property, his property was dry, but since then it has caused runoff from rain to come down onto his property. He also stated that the water line from the wooded part is at least 20 ft. closer to where his lawn ends. He then stated that his cellar is wet as a result, whereas he has never had water in his cellar before. Member Hart then suggested the Commission do a site visit to the property, as that is the only way they can determine what is going on. The Chairman suggested BCAP consultant Terry Eucker should be engaged in the review of this project. The Commission agreed unanimously. M. Kulig will relay this to his clients and that T. Eucker will need a copy of the complete submittal and will then submit an estimate to do the review. A site visit was scheduled for Friday, Sept. 1, 2006 at 5:30 p.m. Edward Shapiro & Donna Elmendorf, 17 Prospect Hill Rd. - NOI Continuance - Marc Volk of Foresight Land Services and Tom Ingersoll of Webster & Ingersoll appeared representing the applicants who propose to do improvements to the existing house, replace an existing old stone foundation with gardens and put in a lap pool. Member Plakun recused herself from the hearing, as she has a conflict of interest. There are wetlands as depicted in yellowish green on the plan. They would like to eliminate the Buckthorn on the property. T. Ingersoll has a machine that goes up and down to get rid of it. The other work in the 100- ft. Buffer Zone is in the proposed pool area. They are doing this project under a Limited Project for a resource area. They are proposing to put in a wet meadow with shrub mix. The cleared Buckthorn area will probably come back as a dogwood area. A site visit was scheduled for Friday, Sept. 1, 2006 at 6:00 p.m. Jonathan Gottlieb & Elisabeth Youngerman, Lakeview Drive, NOI Continuance - Shannon Boomsma of White Engineering and Mr. Gottlieb appeared to discuss the continuance of the NOI. The applicants want to enclose part of the deck and rebuild part of it as a deck. The footings will remain the same. The additional roof run-off will go to splash aprons. They will put in underground drains about 14 inches deep with a perforated pipe. It will then daylight into the wetland. They will abandon the driveway and vegetate it. The silt fence will be maintained throughout the project. Member Shippey made a motion to close the hearing, seconded by member Plakun and all voted in favor. Member Plakun made a motion to issue an extended Order of Condition for Debra Fechter of 17 Mahkeenac Terrace, seconded by member Hart and all voted in favor.
