Thu, Dec 06, 2007 11:14 AM From: Howard Siegel To: StockbridgeMA_BComm Subject: May, 22 2007 CONSERVATION COMMISSION MINUTES OF MEETING TUESDAY, MAY 22, 2007 PRESENT: Sally Underwood-Miller, Stephen Shatz, George Shippey, Cathy Plakun John Hart ABSENT: Joseph DeGiorgis Call Meeting to Order/Adopt Minutes – The Chairman called the meeting to order at 7:00 p.m. Member Shippey made a motion to adopt the Minutes as presented, seconded by member Hart and all voted in favor. Lisa & Mitchell Berliner, 12 East St. – RDA – L. Berliner appeared with her contractor Keith LaFrance to seek permission to install an 18 ft. by 40 ft. in-ground swimming pool 14 ft. from the back of the house. Member Hart did a jurisdictional site visit and found it to be soggy with sheet flow coming down behind the house with buckthorn and possibly hydric soils. The applicant did not have a wetland delineation done on the property. A site visit was scheduled for Friday, May 25, 2007 at 7:30 a.m. Joan’s Beach Nominee Trust, 31 Mahkeenac Terrace – RDA – Shannon Boomsma appeared on behalf of the applicant who seeks permission for an Artesian well overflow discharge construction to alleviate excess water which overflows onto the ground surface. It is creating a wet lawn which is disturbing the well. They would like to put in a one-inch line that will that will flow to an 18 inch. by 24 inch basin and discharge underground. They will use a small piece of equipment to do the work. Most of the work area is already disturbed. They will put in an overflow pipe from the well to a stone basin and drill into the existing well casing. They will be working 36.7 ft. from the top of the bank. Member Shippey made a motion to close the hearing, seconded by member Shatz and all voted in favor. Roy Komack, Interlaken Crossroad – ANRAD Continuance – Terry Eucker was present and stated that she wants one more flag and then she would be happy with the plan as far as the delineation goes. The Chairman wanted it in the record that just because the Commission accepted the wetland delineation it does not make it a building lot. Member Shatz made a motion to close the hearing, seconded by member Shippey and all voted in favor. Frank and Linda Russell, 2 Maple Lane – RDA Continuance– Michael Kulig appeared on behalf of the applicants who seek permission to reconstruct there existing house. M. Kulig did observation holes. The plan showed a wetland line. The backyard is currently mowed. The deck outline on the plan is the building envelope. The plan shows a silt fence. The house reconstruction will be on the same footprint as the current house and put on a frost wall. There is a swale in the back of the property that everything goes into. M. Kulig did a sketch on the plan as to how they will handle it if the 4 ft. did not work. They will put down straw bales around the site during construction. M. Kulig will e-mail the Commission as to how they would handle extra water. Member Shatz made a motion to close the hearing, seconded by member Hart and all voted in favor. Fran Bourdon and Kaz Chwallek, representing the Marian Fathers, and Stephen Mack of Foresight Land Services appeared at the request of the Commission to discuss concerns Commission have that with the use of the field altar and increased use of the parking there would be potential increase in runoff down onto Sergeant Street. They will have tents installed between the garages only on Mercy Sunday. They have arranged parking at Monument Mountain Regional High School and in Lee, thereby restricting the parking at the Marians. Member DeGiorgis had invited K. Chwallek to look at the stream and what was not designed and whether the water was coming from the hill. S. Mack explained that the Marians had White Engineering previously look at the problem and everything appeared to be okay. Arthur Dutil checks daily and logs and keeps everything up to date. They will line the back with trees and shrubs where the trail is and also in the field. The Secretary will send another letter, certified and return receipt to Lucy Jensen requesting she attend the next meeting to discuss the wetland violations that have occurred on her property on Pine Lane.
