Thu, Dec 06, 2007 11:07 AM From: Howard Siegel To: StockbridgeMA_BComm Subject: April, 10 207 CONSERVATION COMMISSION MINUTES OF MEETING TUESDAY, APRIL 10, 2007 PRESENT: Sally Underwood-Miller, Stephen Shatz, George Shippey, John Hart Joseph DeGiorgis, Cathy Plakun ABSENT: Don Deno Call Meeting to Order/Adopt Minutes – The Chairman called the meeting to order at 7:10 p.m. Member Shatz made a motion to adopt the Minutes as presented, seconded by member Shippey, with all voting in favor. Peter Durgin and Robert Jones, representing Berkshire Theatre Festival, appeared at the request of the Commission to discuss the ongoing drainage issues. Member Hart stated that he spoke with one of the neighbors who told him that the run-off from BTF’s property on East St. has made its way into the basement of one of the abutting properties and a stone wall from another abutter is collapsing. BTF has hired Foresight Land Services to come up with a plan to rectify the problem. Steve Mack of Foresight will file that plan in the near future at which time they will come back. Arthur Dutil, representing the Marian Fathers, appeared to discuss their Building Permit application to replace the field altar on the property. It will be located on the south lawn in the location of the existing A-frame field altar which is not adequate for sheltering the Holy Mass celebrated on Mercy Sunday as well as other events throughout the year. They have obtained the services of Foresight Land Services to determine whether the proposed work is within any jurisdictional areas subject the WPA or the SMA. Their findings were that they feel the work proposed is outside the 100-ft. Buffer Zone of any BVW or areas subject to the WPA or SMA. The newly proposed shelter would be 40 ft. X 40 ft. in the center with 24 ft. X 24 ft. for the existing A-frame. The back side and side walls will be solid and the front will open up. They will rotate the building to the west. A site visit was scheduled for Friday, April 10, 2007 at 7:30 p.m. Roslyn Wallace, 5 Lake Drive – RDA – Michael Kulig of Berkshire Engineering appeared representing the applicant who proposes to replace the existing failed septic system on the property. There a couple of wetland resource areas as well as a couple of drainage channels nearby. The existing system will be drained out. The Board of Health gave its approval. M. Kulig will send a copy of the BOH’s approval letter. A site visit was scheduled for Friday, April 13, 2007 at 8:00 a.m. Andrew Warheit of 16 Grove Rd. appeared to request a sign-off from the Commission stating that the abutters sent in letters of approval of his proposed dock extension. The proposed dock would be 32 ft. wide on a 47-ft. parcel. Member Shippey went on record as not being in favor of the size of the proposed dock. Mr. Warheit stated that he needs the bigger dock for his guests, as he has three boats. The dock will be installed in the spring and taken out in the fall. The stakes for the dock are made of metal or steel. Member Shatz suggested he reduce the size of the dock for neighborly reasons. The Commission would like to see a dock of 25 ft. X 8 ft. And member Shatz made that motion. Mr. Warheit will submit a modified plan. Irene Fingerhut, 18 Mahkeenac Shores Rd. – RDA – Shannon Boomsma of White Engineering appeared representing the applicant who proposes to drill a well on her property. The property is connected to Town sewer. The green line on the plan is the 100-FT. Buffer Zone. There will be two slurry pits with straw bales around it. A silt fence will be placed around the work area. They will need to take down one tree located near the well. The lawn area will be restored to its present state. A trench will be dug 27 ft. from the sewer line. S. Boomsma will contact the Commission when they have put in the slurry pits. The Commission will then do a drive by site inspection. Someone from White Engineering will have to monitor the work. Leonard Snyderman, 94 East Main St. – NOI – Robert Levesque of Levesque & Associates appeared with Mr. Snyderman who proposes to rehabilitate the existing house and put in a new Presby septic system. They will need a special permit from the Selectmen and the Planning Board, as they are in the LPOD. The bank is pretty defined. The lawn has been maintained almost to the Housatonic River. They are providing compensatory storage for the fill. The septic system is approximately 150 ft. from the LOPD. A site visit was scheduled for Tuesday, April 17, 2007 at 5:15 p.m. Joseph & Adrienne Silverman, 17 Interlaken Crossroad – RDA – Craig Lang from Okerstom-Lang appeared representing the applicants who propose to repair their driveway. They propose to install an 8-inch culvert at the road, raise the entrance to eliminate standing water caused by the Town putting down asphalt, and install a 6-inch culvert midway along the driveway and apply top dressing of driveway mix. Members Shippey and Shatz will do a site visit Friday, April 13, 2007 between the Wallace and Fingerhut visits. Member Hart left the meeting at 8:20 p.m. Bruce Rubin, 29 Mahkeenac Terrace – NOI Continuance – Shannon Boomsma of White Engineering appeared representing the applicant who proposes to raze and build a new house on the same footprint and install a new dock It was decided at the site visit last Friday that they would modify the plan. The Commission took a “straw” vote to issue an Order of Conditions. The hearing was continued to the next meeting. Sherwood & Judith Gorbach, 23 Mahkeenac Terrace – NOI Continuance – Marc Volk of Foresight Land Services appeared representing the applicants who propose to put on an addition and remodel the existing house. The Chairman went out on the site visit with Mark Lavasser of Foresight Land Services. Member Shatz made a motion to close the hearing, seconded by member DeGiorgis and all voted in favor.
